The Hong Kong Government actively mandates mediation clauses in its contracts, and across the Greater Bay Area (GBA), new cross-border frameworks are creating unprecedented opportunities for accredited professionals. With significant resources dedicated to promoting mediation, it has become an integral part of Hong Kong's legal landscape.

 

For engineers, this shift is particularly significant. Construction projects are inherently complex, often leading to disputes that require efficient resolution. With their deep technical understanding, engineers possess a unique edge in facilitating these resolutions.

 

This seminar, presented by a practising barrister, will explore:

  • The fundamentals of dispute resolution through mediation, with reference to construction, personal injury, and general civil claims.
  • Why engineers and technical professionals are uniquely positioned to excel as mediators, bridging the gap between technical facts and legal arguments.
  • The latest developments in mediation, including the M-case Settlement Conference and its implications for the industry.
  • Emerging opportunities for dispute resolution professionals within the Greater Bay Area (GBA), including new institutional frameworks and cross-boundary cooperation.
  • A practical guide on the pathways and requirements to qualify and register as a professional mediator in Hong Kong.

Speaker:

Andy C.Y. Kwok is a practising barrister-at-law and holds accredited qualifications as both a general and family mediator in Hong Kong. Last year, he was selected as a "Guangdong-Hong Kong-Macao Greater Bay Area Mediator," becoming the youngest among the 233 members on the panel.

 

His practice spans a wide range of legal areas, including:

  • International (cross-border) arbitration and commercial law
  • Construction disputes
  • Personal injuries and criminal law
  • Matrimonial law, particularly matters relating to custody and financial arrangements

 

With extensive teaching experience, Andy currently serves as a guest lecture at several local tertiary institutions, including the Department of Law at City University of Hong Kong, the School of Nursing and Health Studies at Hong Kong Metropolitan University, and the School of Professional and Continuing Education at the University of Hong Kong, where he teaches mediation and law-related subjects.

 

On the academic front, he has contributed as an annotator for the Mediation Ordinance in LexisNexis's Annotated Ordinances of Hong Kong. He was also invited to co-author a background paper on "The Use of Mediation in ISDS" for a UNCITRAL Working Group III meeting, demonstrating his international perspective and profound expertise in the field of mediation.
