Speakers:

Paul Roberts, is a vastly experienced Adjudicator who has published almost 100 Adjudication Decisions across various jurisdictions. With more than 32 years experience in the Construction and Engineering Industry, a decade of which being in Hong Kong, he leads Aquenta Consulting’s Contract, Commercial & Dispute Service Line. His straight forward approach, vast experience and high integrity make him a renowned and trusted advisor to legal and construction clients around the world. His portfolio of services under all main standard forms and bespoke forms alike, includes dispute avoidance and resolution, commercial management, procurement advice and contract management gained on a wide range of complex ventures in building, engineering, mining and petrochemical projects in Australia, UK, Middle East and South East Asia. In addition to his vast experience as Adjudicator, Paul is regularly called upon to act as arbitrator, expert determiner and mediator to assist parties avoid, or resolve, disputes concerning quantum, extensions of time and contractual matters. He is also a tertiary level tutor and external examiner.

Dennis Wong, is a counsel in Clyde & Co's Hong Kong and China Construction Group. He is an arbitration and litigation lawyer. He specialises on construction related disputes. Dennis has done many domestic arbitrations in Hong Kong concerning disputes arising from civil engineering, piling and building projects. Dennis advises Government, Employer, Contractors, Engineers and a variety of other clients in Hong Kong, Macau and China. He also has experience in international arbitration such as ICC arbitration concerning project in Azerbaijan.

Ian Cocking, is head of the Construction Engineering and Infrastructure Department of Clyde & Co Hong Kong and China. Based in Hong Kong since 1988, Ian's experience includes advising both public sector and private sector clients on infrastructure development, construction issues and environmental law. He also has significant experience advising on transport, IT and outsourcing projects. Ian has advised on building and engineering contracts in various parts of the region, acting on behalf of employers, consultants, main contractors and sub-contractors. Before becoming a solicitor he was originally a barrister in England. Ian became an accredited mediator in 2001. He is the past Chairman of the Society of Construction Law Hong Kong and the Hong Kong Environmental Law Association.

 

 

Programme Highlights

Adjudication is the process by which an adjudicator reviews evidence and submissions presented by parties to a dispute and decides the parties’ respective rights and obligations. Adjudication provides a quick process for the resolution of disputes which arise during the currency of a contract in a flexible and cost effective manner. Adjudicators’ decisions are binding unless and until changed after fuller consideration and final determination in subsequent arbitration or litigation.

The Development Bureau of the Hong Kong Government has recently published a consultation document entitled “Proposed Security of Payment Legislation for the Construction Industry” and the proposed legislation aims to enhance the security of payment in construction-related contracts with adjudication for speedy resolution of construction dispute.

The Adjudication Seminar Series aims at providing more opportunities for Engineers to understand more about the new issues that will be introduced into the construction industry and provide an excellent opportunity for participants to have a better understanding of Adjudication and the NEC3 contracts.
